Welcome to Dwellium ("Platform"), a cloud-based Customer Relationship Management (CRM) platform designed for travel agencies, tour operators, travel consultants, and related businesses.
By registering, accessing, subscribing to, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and other applicable policies published by Dwellium.
Use of Services
Dwellium grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform during your active subscription solely for your internal business purposes.
You shall not copy, modify, distribute, reverse engineer, resell, or misuse the Platform or any part thereof.
Account Responsibility
You must provide accurate information and promptly update any changes. You are responsible for maintaining the confidentiality of your account credentials and for all activities performed through your account.
Subscription and Payments
Access to the Platform is subject to the subscription plan selected by you.
All fees are payable in advance and are non-refundable except as expressly provided under the applicable Refund Policy.
Dwellium reserves the right to suspend or terminate access for non-payment.
Customer Data
You retain ownership of all data uploaded or processed through the Platform.
You are solely responsible for ensuring that your collection, storage, use, and processing of such data complies with all applicable laws and regulations, including the Digital Personal Data Protection Act, 2023 (DPDP Act).
You represent that you have obtained all necessary consents and authorizations required to process such data.
Privacy and Compliance
Dwellium processes data in accordance with its Privacy Policy.
By using the Platform, you acknowledge and agree to comply with all applicable laws, regulations, industry standards, and statutory obligations relevant to your business operations and use of the Platform.
Third-Party Services
The Platform may integrate with third-party services including communication providers, payment gateways, booking systems, APIs, and other external platforms.
Such services are governed by their respective terms and policies, and Dwellium shall not be responsible for their availability, performance, or actions.
Intellectual Property
All rights, title, and interest in and to the Platform, software, trademarks, content, documentation, and related intellectual property remain the exclusive property of Dwellium and its licensors.
No ownership rights are transferred to you.
Suspension and Termination
Dwellium may suspend or terminate access to the Platform if you violate these Terms, fail to make required payments, engage in unlawful activities, or create a security or operational risk.
Disclaimer and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Dwellium shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of the Platform. "Except in cases of fraud, wilful misconduct, or gross negligence, Dwellium's total liability shall not exceed the subscription fees paid by the User during the preceding six (6) months."
Changes to Services and Terms
Dwellium may modify, enhance, discontinue, or update the Platform and these Terms at any time.
Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
